Terms of Service

Welcome to PartyUp. By using the PartyUp mobile application ("App"), our website, and related services (together, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years old (or the higher minimum age set by your country's data protection or content laws) to use PartyUp. By creating an account, you confirm that you meet this requirement. We reserve the right to suspend or terminate accounts that we reasonably believe belong to underage users.
Some features — including hosting live streams, sending paid gifts, becoming a paid creator, and withdrawing earnings — may require additional age verification or may not be available in your region.
2. Account
- You are responsible for maintaining the security of your account.
- You may sign in using Apple, Google, or continue as a guest.
- Guest accounts are temporary and have limited functionality (cannot host streams, send gifts, or receive friend requests).
- You agree to provide accurate information and keep your profile appropriate for a public-facing platform.
- You are responsible for all activity that occurs under your account.
3. Acceptable Use
When using PartyUp, you agree NOT to:
- Harass, bully, threaten, or intimidate other users
- Share obscene, sexually explicit, hateful, violent, or otherwise illegal content
- Broadcast or facilitate the broadcast of nudity or sexual activity
- Promote self-harm, suicide, eating disorders, or dangerous challenges
- Post or share content that infringes the intellectual property rights of others
- Impersonate another person or misrepresent your identity
- Attempt to cheat, hack, exploit, or reverse-engineer the Service
- Use bots, scripts, or automated tools to interact with the Service
- Spam other users with unsolicited invitations, gifts, or messages
- Attempt to record, capture, or redistribute other users' streams without their consent
- Use the Service for any unlawful purpose or to facilitate illegal activity
- Solicit or attempt to obtain personal information from minors
We reserve the right to remove content, suspend, or permanently ban any account that violates these rules, with or without notice.
4. Live Streaming & Rooms
- Anyone with an eligible account may host a live stream by tapping Go Live.
- Hosts are responsible for the conduct, content, and atmosphere of their rooms, including any guests they invite to co-host.
- Hosts can mute, kick, or ban viewers from their own rooms.
- Live rooms support large viewer counts. Public rooms are visible in the discovery feed; private rooms are accessible only via a share link.
- We do not pre-screen or record live broadcasts, but we may sample chat, gift, and metadata signals for safety enforcement.
- We reserve the right to terminate any live stream or room that we determine, at our sole discretion, violates these Terms.
5. Coins, Gifts & Virtual Items
- "Coins" are an in-app virtual currency you can purchase through Apple App Store In-App Purchase or Google Play Billing.
- Coins have no cash value, are not transferable between accounts, and cannot be redeemed for money by the purchaser.
- Coins are spent on virtual gifts that you can send to hosts during live streams. Once a gift is sent, the transaction is final.
- All coin purchases are subject to the platform store's refund policy (Apple or Google). Refund disputes for IAP must be raised with Apple or Google directly.
- We may modify the price, availability, or design of coins, gifts, and virtual items at any time without notice.
- Any unused coins are forfeited if your account is terminated for violation of these Terms.
6. Host Earnings & Withdrawals
- Hosts who receive virtual gifts may convert them to host earnings, subject to a transparent platform commission shown in-app before any transaction.
- Withdrawals are subject to a minimum payout threshold and identity verification, and are processed only to a payout method registered to the same legal person as the PartyUp account.
- Hosts are solely responsible for any taxes, duties, or fees applicable to their earnings in their jurisdiction. We may issue tax documents where required by law.
- We may delay, hold, or reverse any payout if we reasonably suspect fraud, money laundering, charge-back abuse, or violation of these Terms.
- Earnings derived from violating accounts may be forfeited.
7. Reporting & Moderation
- Any user can report another user, a stream, or a message from within the App.
- Reports are reviewed and acted upon according to severity. Urgent safety reports are prioritised.
- You can block any user. Blocked users cannot view your profile, send you DMs, or join your streams.
- We comply with valid legal requests from law enforcement and may share information where required by law.
8. User Content & License
- You retain ownership of the content you create on PartyUp (including your stream broadcasts, chat messages, and profile content).
- By posting content on the Service, you grant PartyUp a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and adapt your content solely for the purpose of operating, providing, and improving the Service.
- This licence ends when you delete the relevant content or your account, except to the extent we are required to retain it for legal, safety, or backup purposes.
9. Intellectual Property
- The PartyUp name, logo, design, gift artwork, and all related content are our intellectual property.
- You may not copy, modify, distribute, sell, or create derivative works based on the Service without our written permission.
10. Termination
- You may delete your account at any time from the App: Profile › Danger Zone › Delete Account.
- We may suspend or terminate your account at our discretion if you violate these Terms or engage in conduct harmful to other users or the platform.
- Upon termination, your right to use the Service ceases immediately, unused coins are forfeited, and pending payouts may be withheld pending review.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure, and we do not guarantee any specific level of viewers, gifts, or earnings for hosts.
12. Limitation of Liability
To the maximum extent permitted by law, PartyUp and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. This includes, but is not limited to, damages for loss of data, loss of profits, loss of coins or gifts, or personal injury.
13. Third-Party Services
The Service integrates with third-party services (Agora for video, Apple and Google for authentication and payments, Firebase for notifications). Your use of those services is also subject to their terms and privacy policies. We are not responsible for the practices of third-party providers.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
15. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which PartyUp is operated. Any disputes arising under these Terms will be resolved through good-faith negotiation or, where required, binding arbitration. You agree to bring any claim individually and waive your right to participate in any class action against us.
